Product Terms and Conditions

These terms apply to every software product that Software KC, LLC ("Software KC," "we," or "us") sells directly, and to the shared platform those products run on. By creating an account or using one of our products, you agree to these terms. If you're accepting them for an organization, you confirm you're authorized to do so.

Some products have their own supplement, published at /products/[product name]/terms-and-conditions and linked from inside the product. A supplement adds to these terms for that product. If a supplement and these terms disagree, the supplement applies for that product. Our website Terms of Service cover this website, not the products.

How we handle your information is explained in our Product Privacy Policy.

1. Your Account

  • Keep your account information accurate, and keep your sign-in details to yourself.
  • Tell us right away at hello@softwarekc.com if you suspect someone else is using your account.
  • If your account belongs to an organization, the organization's administrators can invite and remove users, manage their access, and see the organization's data in the product.

2. Single Sign-On and Connected Accounts

One account signs you in to all of our products. You can create an account with us directly, or sign in with an account you already have, such as Google or Microsoft.

Some products let you connect another account, for example to sign in or to bring information from another service into your dashboard. A connection only happens when you choose it, using a clearly labeled button such as "Connect Google" or "Connect Microsoft," and it's used only for the purpose shown when you connect. You can disconnect at any time. Your use of those services is also governed by their own terms.

3. Subscriptions and Billing

  • Paid products are billed by subscription, at the price and billing period shown when you subscribe.
  • Payments are processed by our payment processor, currently Stripe.
  • Subscriptions renew automatically until you cancel. You can cancel at any time, and the cancellation takes effect at the end of the current billing period.
  • We'll give you notice before a price change takes effect, so you can decide whether to continue.

4. Your Data

The information you and your organization put into our products ("your data") belongs to you.

  • You give us permission to store, process, and transmit your data only as needed to provide, secure, and support the products, and as you direct.
  • We don't sell your data, and we don't use it for advertising.
  • You're responsible for having the right to put your data into the product, including any information about other people.

5. AI Features

Some products offer AI features, provided through Anthropic or through OpenAI models on Microsoft Azure. When you use one, the information needed for that request is shared with the AI provider named in the product's supplement, which returns a result to you. If you don't use AI features, nothing is shared with an AI provider.

AI output can be wrong or incomplete. Review it before relying on it, especially for decisions that matter to your business.

6. Acceptable Use

Don't use our products to break the law, harm others, send spam, distribute malware, try to get around security or usage limits, access other customers' data, or interfere with the platform's operation.

7. Our Products

Software KC owns the products and the platform, including their code and design. While your subscription is active, we give you a non-exclusive, non-transferable right to use them under these terms. If you send us suggestions, we may use them to improve our products without any obligation to you.

8. Availability and Changes

We work to keep our products reliable and available, but we can't promise they'll be uninterrupted or error-free. We regularly improve the products, and we'll let you know in advance about changes that significantly affect how you use them.

9. Ending Your Account

  • You can close your account at any time. Before you do, you can ask us for a copy of your data.
  • We may suspend or close an account that violates these terms or puts the platform or other customers at risk. Where practical, we'll tell you first and give you a chance to fix the problem.

10. Disclaimers and Limitation of Liability

Except as stated in these terms, the products are provided "as is." To the extent the law allows, Software KC is not liable for indirect, incidental, or consequential damages, such as lost profits or lost data, and our total liability for any claim is limited to the amount you paid us for the product in the 12 months before the claim.

11. Changes to These Terms

We may update these terms. We'll post changes on this page, and for significant changes we'll notify you by email or in the product before they take effect.

12. Governing Law

These terms are governed by the laws of the State of Missouri, USA.
